Legal and notary support in Spain
A property purchase or sale in Spain must be completed before a notary. The notary is an independent public official responsible for ensuring legal certainty and verifying that the transaction complies with Spanish law.
The notary prepares the deed of sale, which becomes a public document once signed. This deed is registered in the land registry and cadastre, providing the highest level of legal security. Public deeds are legally binding and fully recognised by authorities and courts.
Before signing, the notary verifies ownership, checks for debts or encumbrances, confirms urban planning compliance, and ensures there are no outstanding obligations with the municipality or homeowners’ association. If issues are identified, the notary advises on the steps required to complete the transaction safely.
Several documents are required for the transaction, including valid identification, NIE or TIE, energy efficiency certificate, proof of payments, community certificates, habitability documents, and tax receipts such as the IBI (SUMA).
